Wayne is a career litigator with a full range of experience from pre-suit risk analysis to trials and appeals. His litigation experience spans defending single-plaintiff cases to class actions, in addition to serving as national counsel in multi-district litigations. Wayne has personally overseen hundreds of litigations to completion either directly or via oversight of local counsel, negotiating countless settlements.
His litigation practice includes a wide array of high-profile product liability actions involving pharmaceuticals, medical devices, personal care products, hair dyes and consumer-use products, including products named in class action PFAS litigations. In addition, Wayne has extensive experience in the defense of medical malpractice, transportation, toxic tort and environmental exposure cases. He is also experienced in all phases of e-discovery, having supervised the attorney-client privilege review of one of the largest document productions in litigation history.
Wayne's environmental practice focuses on both civil and criminal matters, including CERCLA matters, addressing claims of property damages, stigmatization, and personal injury alleged in response to exposure to mold, mixed chemical exposures, PFAS, residential heating oil, and other environmental factors. He has negotiated extensively with the Department of Environmental Conservation, representing a major oil distributor in three states at both the State and Federal level.
His commercial litigation experience includes litigating a multi-million-dollar contract dispute on behalf of one of New York's largest corporate municipalities, taking depositions as well as drafting and arguing dispositive motions.
Wayne has also managed the selection and preparation of expert witnesses in diverse fields including FDA regulations, proper maintenance of HVAC systems, and medical causation flowing from exposure to mold, oil, and other industrial hygiene products.
