KT Attorney Andrew Marcus wins for the defense on summary judgment in the Supreme Court of Suffolk County, New York, in a case in which Plaintiff sued for negligence, alleging that construction debris left behind in a roadway adjacent to where our paving company client had performed work, caused the motorcycle that he was operating to slide and crash into the back of a parked car. In a motion for summary judgment, Mr. Marcus argued that the record established by the defense demonstrated that our client did not cause Plaintiff’s accident, and that the company had complied with the mandates of its municipal paving contract and all applicable roadway construction standards. Based on this record, the court granted summary judgment in favor of the client.
