Kiernan Trebach prevailed in a labor law claim against the general contractor for a construction project on the grounds that the injured employee was performing work outside the scope of work. The injured employee was employed by the owner of the premises, and the court agreed with Kiernan Trebach’s argument that our client was not a proper labor law defendant in this instance.
