Details: The MD Transportation code provides that as a condition precedent to filing suit, where sovereign immunity applies, suit must be filed within 3 years of the incident.
The pertinent issue involved in this claim was not a statute of limitations defense, but rather that the code provision created a condition precedent to filing suit. After hearing argument, the Court ruled in our favor, finding that Plaintiff had failed to meet the condition precedent. The Court further assessed costs against Plaintiff.
