Nancy is a partner in the firm’s Richmond, VA office with over 25 years of experience defending long term care communities, hospitals, physicians, nurses, and long term care administrators. She has defended clients across Virginia in all stages of litigation and at trial, arbitration, mediation and regulatory proceedings. Nancy’s representation goes beyond the traditional medical negligence defense to premises liability and contract breach cases and consumer protect act claims. She supports and defends practitioners through regulatory agency and board investigations and appeals adverse findings. Nancy also provides risk management advice and assists health care providers with creating policies and procedures.

Notable Matters

Defense verdict in long term care case with four falls resulting in hip and C-2 vertebra fracture.

Dismissal of independent living facility negligence case based on landlord-tenant relationship of facility and resident creating no duty of care.

Dismissal of Virginia Consumer Protection Act case against assisted living facility for lack of standing when plaintiff administrator qualified under probate code only permitting wrongful death and survival claims.

Reversal of rape case against skilled care facility because employee conduct was not within scope of employment.

Finding that motion craving oyer was not limited to deeds and letters probate, resulting in change in Virginia Supreme Court Rules.

Finding that opt-out provision in Virginia Medical Malpractice Act for arbitration clauses is a violation of the Federal Arbitration Act.
