KT Attorney Erik Fawcett wins for the defense on summary judgment in the Circuit Court for Baltimore County, Maryland. Plaintiff’s decedent resided in an assisted living facility, where he contracted legionnaires’ disease and later passed away. Plaintiff’s estate sued for wrongful death and alleged that our client (a water management entity) failed to inform the assisted living facility of the legionella risk and failed to correct a legionella contamination.
In a motion for summary judgment, Mr. Fawcett successfully argued that the record in the case could not support a finding of negligence/wrongful death on the part of our client and the court granted summary judgment in favor of our client.
